Terms & Conditions

Suntech Solar Pty Ltd | ABN 60 602 648 135 | Trading as Ausuntech Energy

The customer who signs this Agreement hereby agrees to all terms and conditions herein.
This Agreement may be executed in counterparts; each counterpart is deemed an original.
Binding upon signature and delivery via electronic or physical means.
Sale price depends on STC (Small-scale Technology Certificate) value. If it drops more than 15–20% before installation, Ausuntech Energy may adjust the final price.
If RET Program changes, pricing will adjust accordingly.
Remaining balance is due on installation day; all paperwork will be processed after payment.
Customer agrees to assign STCs to Ausuntech Energy unless otherwise arranged. Retaining STCs requires full upfront payment.
Additional charges may apply if the installation falls outside of standard scope (as outlined in front page).
Agreement includes a 10-day cooling-off period with full refund.
This contract excludes: meter upgrades, switchboard/relay/fuse upgrades (unless specified).
Feed-in tariffs are state-regulated. Ausuntech is not liable for any legislative changes.
System performance depends on environment and shading; generation estimates are approximations.

Customer agrees to pay as per terms in this Agreement.
Deposit is due upon signing or 10 days after cooling-off period.
Full balance due on installation day. Until paid in full, the system remains property of Ausuntech Energy.
Failure to pay may result in removal of equipment. Removal cost: $0.40 per watt, travel: $2/km round trip.
Overdue amounts incur 15% annual interest, calculated daily.
Customer bears legal and debt collection costs in case of default.

Commercial Only

This agreement is not the product warranty document.
Product warranties are provided by manufacturers and tracked via serial numbers.
Ausuntech provides:
✓ 5-Year Comprehensive System Warranty
✓ 10-Year Installation Warranty
Replacement parts may be from equivalent third-party manufacturers.
All goods include non-excludable guarantees under the Australian Consumer Law.

Only warranties listed in this Agreement or Australian law apply.
Liability for breach is limited to repair or replacement of defective goods.
No compensation beyond this unless legally required.
Excludes responsibility for:
- Grid voltage issues
- Radio/TV interference
- Force majeure (weather, surges, animals, etc.)
- Customer negligence or misuse

Customer may terminate in writing:
- Within 5 days of signing; or
- Within 10 days if deemed an unsolicited agreement.
Prepaid amounts are retained and applied to account balance.
Late fees/interest continue until full payment is made.
If installation is not completed within 3 months of the estimated timeframe (6 weeks post-deposit), customer may cancel for refund.
If additional charges arise during inspection/installation, customer may cancel.
Unsolicited sales follow 10-business-day cooling-off period under Section 82 of Australian Consumer Law.
Cancellations after cooling-off incur $200 admin fee (ex. GST).
Energy supplier approval fees are non-refundable.
Ausuntech may cancel contract with 3 days’ notice, with full refund to the customer.

Contract is governed by the laws of WA, SA, NSW, QLD, and VIC.
Any legal proceedings must be initiated in the state relevant to the installation, with preference to the Perth registry.

All prices are exclusive of GST and government charges, unless stated otherwise.
Ausuntech Energy is not liable for product damage due to:
- Flood, fire, storm, accident, earthquake
- Other uncontrollable or external events
